Identify the real parties
List contracting entities, guarantors, beneficial interests, agents, affiliates and individuals whose conduct matters. Confirm legal names and locations. Commercial brands and email domains are not substitutes for identifying the correct legal person.
Read the dispute clauses as a system
Governing law, jurisdiction, arbitration, escalation, service, language and notice clauses can interact. Check amendments, incorporated terms and competing documents. A strong substantive claim may be weakened by missing a contractual notice step.
Build an evidence and chronology map
Organise contracts, variations, invoices, payments, messages, system records and witness knowledge by issue and custodian. Mark where data is stored and whether preservation or access restrictions exist in each country.
Locate assets and practical leverage
Before committing to a forum, consider where a judgment or award must ultimately have effect. Identify known assets, insurers, payment intermediaries, active contracts and business relationships without using improper pressure.
Compare routes, cost and urgency
Negotiation, mediation, court proceedings, arbitration and urgent interim measures serve different purposes. Compare timing, confidentiality, evidence access, cost, enforceability and commercial impact, then preserve flexibility where the facts are still developing.
